DOE Requests Comments on NESHAPS for Gasoline Distribution Bulk Terminals, Bulk Plants, Pipeline Facilities, and Gasoline Dispensing Facilities

On November 28, 2006, the Office of Nuclear Safety and Environmental Assistance (HS-22) issued a post card requesting comments on EPA’s proposed rulemaking, "National Emission Standards for Hazardous Air Pollutants for Source Categories: Gasoline Distribution Bulk Terminals, Bulk Plants, Pipeline Facilities, and Gasoline Dispensing Facilities" (71 FR 66064; November 9, 2006). The rule would be potentially applicable to gasoline dispensing facilities and fleet gasoline tanks at DOE sites. DOE field and program offices are asked to review this proposed rule and submit comments by December 15, 2006, to Mr. Emile Boulos at: emile.boulos@eh.doe.gov; 202-586-1306. In developing comments, please indicate the specific page and section of the preamble and the proposed rule in the Federal Register to which each comment pertains. DOE, DOI and FWS Sign MOU on Migratory Bird Protection

On August 3, 2006, a Memorandum of Understanding among DOE, the Department of Interior (DOI), and the U.S. Fish and Wildlife Service (FWS) was completed. The MOU addresses how DOE and DOI may cooperatively handle migratory bird protection and conservation and ensure that DOE operations are consistent with the requirements of the Migratory Bird Treaty Act (MBTA) and Executive Order (EO) 13186, "Responsibilities of Federal Agencies to Protect Migratory Birds." EO 13186 specifically directs Federal agencies whose actions have, or are likely to have, a measurable negative impact on migratory bird populations, to incorporate migratory bird conservation measures into their activities. The MOU serves to strengthen migratory bird protection and conservation through enhanced collaboration between DOE and FWS, and fulfills DOE's obligation under EO 13186. Final Rule on Measurement Methods of Visible Air Emissions Issued

On September 21, 2006, the Office of Nuclear Safety and Environmental Assistance (HS-22) issued a notice entitled, "Clean Air Act Regulatory Update: Issuance of Final Rule on Measurement Methods of Visible Air Emissions" which discusses a final rule (71 FR 55119) that provides three alternative testing procedures for determining the opacity of emissions plumes from industrial facilities. The final rule has the potential to affect DOE sites with sources of visible emissions, such as coal-fired steam generating units. HS-20 will prepare an analysis of this final rule and provide it to program and field offices. Questions on the rule should be directed to Ted Koss (202-586-7964) of HS-20. DOE Comments on CAA Standards for Stationary Spark Ignition and Reciprocating Internal Combustion Engines Available

On October 11, 2006, the Office of Nuclear Safety and Environmental Assistance (HS-22) transmetted comments to the Environmental Protection Agency (EPA) entitled, "United States Department of Energy (DOE) Comments on 'Standards of Performance for Stationary Spark Ignition Internal Combustion Engines and National Emission Standards for Hazardous Air Pollutants for Reciprocating Internal Combustion Engines' Proposed Rule (71 FR 33804; June 12, 2006)." All of the DOE comments address EPA's proposed National Emission Standards for Hazardous Air Pollutants (NESHAPS) affecting emergency stationary internal combustion engines.
